This Acceptable Use Policy (this "Policy") describes prohibited uses of the services offered by VisibleGains and the websites located under http://*.visiblegains.com (the "VG Sites"). The examples described in this Policy are not exhaustive. We may modify this Policy at any time by posting a revised version on the VisibleGains Site. By using the Services or accessing the VG Sites, you (the "Subscriber") agree to the latest version of this Policy. If you violate the Policy or authorize or help others to do so, we may suspend or terminate your use of the Services.

In using the VG Sites and services you accept and agree that the following actions are expressly prohibited by VisibleGains and that violators are subject to legal prosecution:

 

• Transferring or storing illegal content and / or materials protected by trademark, copyright, patent, or other intellectual property without proper authorization.
• Storing or distributing any content that is in any way fraudulent of misleading, for the purposes of deceptive advertising or promotion of deceptive products or services.
• Uploading, emailing, and / or broadcasting SPAM, hate speech or offensive, obscene, pornographic, threatening, libelous, defamatory, or harassing material.
• Uploading, emailing and / or broadcasting any "hate speech" material that is directed at a particular definable class
• Violating the security of any computer network or transmitting any harmful content including viruses, trojan horses, and worms
• Cracking or attempting to crack passwords or security encryption
• Any other illegal act or activity
  
  

Uploading videos and / or submitting comments or creating a profile or account through VisibleGains’ Service, with depictions of pornography, anything sexually explicit, violence, hate speech, or anything illegal or dangerous is prohibited. Violators shall be subject to prosecution by law.

Uploading videos and / or submitting comments or creating a profile or account through VisibleGains’ Service, with degrading, violence inciting hate speech, intimidating language or language which includes prejudiced speech or stereotypes about a particular definable class, gender, sexuality, ethnicity, national origin, religion or political affiliation is prohibited by VisibleGains. Violators are subject to prosecution by law.

Uploading videos and/or submitting comments or creating a profile or account through VisibleGains’ Service, that includes hate speech, or degrading, demeaning, threatening or harassing personal attacks is prohibited by VisibleGains. Violators are subject to prosecution by law.

It is the responsibility of Customer to immediately take action to prevent any known or suspected Policy violations and immediately report the violation to VisibleGains. Should VisibleGains become aware of any violation as solely determined by VisibleGains, VisibleGains reserves the right to block access to any content, suspend or terminate any affected service, or take action deemed appropriate by VisibleGains.

VisibleGains will attempt to provide notice to Customer if VisibleGains deems it necessary to suspend or terminate a service, but VisibleGains reserves the right to suspend or terminate a service immediately without notice to Customer if VisibleGains, at its sole discretion, determines that the violation is harming VisibleGains' service, network, customers, or users.

VisibleGains will not be liable for any damages of any nature that may result from a violation of this Policy, and Customer hereby indemnifies VisibleGains against any and all damages that may arise from a violation of this Policy by Customer or Customer's Users.
